Your privacy is very important to us, and we are dedicated to protecting it. We strive to be as transparent as possible about how and why we use the personal data that you give to us, and how we comply with the relevant data protection laws on your personal information.

Your personal data – what is it?

Personal data relates to a living individual who can be identified from that data. Identification can be by the information alone or in conjunction with any other information in the data controller’s possession or likely to come into such possession. The processing of personal data is regulated here in Ghana by the Data Protection Act 2012 (Act 843) and in Europe by the General Data Protection Regulation 2016/679 (the “GDPR”).

How do we process your personal data?

In compliance with the requirements in Act 843 and the GDPR, the Spiritual Songs App keeps your personal data up to date by storing and destroying it securely, by not collecting or retaining excessive amounts of data, by protecting your personal data from loss, misuse, unauthorized access and disclosure, and by ensuring that appropriate technical measures are in place to protect your personal data.

What is our legal basis for processing your personal data?

Section 37 (5) of Act 843 is our legal basis for processing your personal data collected in Ghana, where “…the processing is carried out for the protection of the legitimate activities of a body or association which is established for non-profit purposes, exists for political, philosophical, religious or trade union purposes, relate to individuals who are members of the body or association or have regular contact with the body or association in connection to its purpose, and does not involve the disclosure of the personal data to a third party without the consent of the data subject.”

In relation to foreign data collected from jurisdictions that are subject to the GDPR, Article 6(1) (f) of the GDPR gives us a legal basis for processing data where “processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.”

Under Article 9(2) (d) of the GDPR, we are permitted to process sensitive data when it is “carried out in the course of its legitimate activities with appropriate safeguards by a foundation, association or any other not-for-profit body with a political, philosophical, religious or trade union aim, and on condition that the processing relates solely to the members or to former members of the body or to persons who have regular contact with it in connection with its purposes.”
